1. Introduction

This is the Terms of Service for Dexbonus.co.uk and associated services provided by Amarielleu Media. This policy is effective as of 25 May 2018 and was last updated on 13 November 2021.

These are the Terms and Conditions of the services operated by Amarielle Media and any affiliated companies or persons (the “Provider”) consisting of its networks of websites, social applications, chat moderation services or any other product or service offered by the Provider (the “Provided Services”). Other services run by the Provider may be subject to additional terms.

When using the Provided Services you are subject to the Provider's Privacy Policy, are subject to any additional guidelines or rules that are posted on the Provided Services or any services which are provided to you including, but not limited to, additional features, social groups and unreleased services. The Provider uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.

The Terms of Service apply whether you have registered an account through one of our Provided Services or are an unregistered user. You agree that by joining one of our Provided Services or otherwise registering, accessing, consuming or using the Provided Services, you are entering an agreement regarding your use of the Provided Services. By continuing to use the Provided Services you acknowledge that you have read, understood, and agree to these Terms of Service. Amarielle Media may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

If you do not agree with the Terms of Service, you are prohibited from using or accessing this site and should not access or otherwise use any of the Provided Services. You must not access Provided Services if you are under the age of legal majority in your jurisdiction of residence and cannot give consent to be bound by these Terms of Service. By continuing to use the Provided Services you consent to these Terms of Service and represent that you are at least the age of legal majority in your jurisdiction of residence and that you are not prohibited from accessing or receiving the Provided Services.

3. Accounts

A. Creation of Accounts

The Provided Services may permit you to register for an account to perform all functions, in order to open an account you will be asked to provide us with certain information such as a full name, email address and password. To register an account you must be a natural person. Accounts registered by bots, networks or other automated methods are not permitted to access the Provided Services.

You are solely responsible for the confidentiality and security of your account information and password. Please ensure the information you provide upon account registration is true, accurate and complete. Accounts found to have given false details will be deactivated. Your account may not be accessed by anyone else and you must be the sole owner of the account. Access to the Provided Services may be prevented by IP address filtering, account removal and in serious cases, direct contact with Internet Service Providers.

Third party accounts may be used to access some of the Provided Services. Third party accounts are subject to their own Terms of Service, Privacy Policy and Rules. The Provider does not share information with third parties, further information about how the Provider collects and uses your personal information can be found in the Privacy Policy.

If you believe your account or a third party account is no longer secure please immediately notify the Provider. You are solely responsible for all content posted and activities which originate from your account. You cannot use the Provided Services for any illegal or unauthorised purposes. You must not, in the use of the Provided Services, violate any laws in your jurisdiction.

B. Termination of Account

You may request the termination of your account at any time. In order to terminate your account you must contact support via our email, [email protected]. Personal Information related to your account may be stored beyond the life of your account under a legitimate interest legal basis to allow correct and appropriate moderation services to be applied. Further information about how your personal information may be used and how to request deletion of personal data can be found in the Privacy Policy.

4. Access to Services

To access the Provided Services the Provider may require the use of a internet enabled device as well as communication with and use of space on the internet enabled device. You are solely responsible for providing a compatible internet enabled device and are responsible for any charges which may be incurred whilst accessing the Provided Services.

Any paid plans must provide a valid account through one of the approved payment providers. Free accounts are not required to provide an account through an approved payment provider. Upon upgrade from the free plan to any paid plan you will be immediately billed.

Any paid Provided Services are billed instantly and are non-refundable. Any and all fees are exclusive of taxes, levies or duties imposed by taxing authorities, You are solely responsible for the payment of all such taxes, levies or duties. Breaches of the Community Rules or third party terms of service will not entitle you to a refund. Any and all donations and payments made to the Provider are not refundable.

You have no ownership of any content on the Provided Services, including, but not limited to, any virtual goods appearing on or originating in the Provided Services or any other attributes associated with any Account or Services.

5. License

Permission is granted to temporarily use one copy of the materials from the Provider's Provided Services for personal, non-commercial use only.

This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any Provided Services; remove any copyright or other proprietary notations from the Provided Services; or transfer the materials to another person or "mirror" the Provided Services on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by the Provider at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession.

6. User Generated Content

The Provider claims no intellectual property rights over any materials you upload, type, share, post, publish or broadcast (“Content”) on the Provided Services. By agreeing to these terms you agree that other members of Provided Services may access and view your Content. The Provider does not screen Content, but the Provider have the right to refuse or remove any Content.

You are solely responsible for Content you provide and the consequences of uploading, posting or publishing Content on Provided Services. You must be the creator and owner of the Content or otherwise have sufficient license and authority to grant the following rights. (a) Content must not harass or defame any other natural person; (b) Content must not infringe or violate any third-party rights including, but not limited to, copyright, trademark, patent, moral right, privacy right, trade secrets, proprietary right, right of publicity or any other intellectual property right; (c) Content must not contain malware, viruses, malicious code, adware, worms, spyware, or other harmful code; (d) Content must not contain any pre-release or non-public information including, but not limited to, leaks, private alpha content, testing releases or confidential information; (e) Content must not be unlawful, pornographic obscene or otherwise objectionable.

Content provided must not amount to promotion, advertisement, contest, sweepstake or marketing. Content must not endorse any product or service.

7. Limitations

In no event shall the Provider be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Provided Services, even if the Provider has been notified of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

8. Disclaimer

The materials and Content on Provided Services are provided on an 'as is' and 'as available' basis. The Provider makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, the Provider does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on Provided Services or otherwise relating to such materials or on any sites linked to Provided Services.

9. Miscellaneous

a. Survival

Upon termination of these Terms and Service, any clause which should survive, will survive such termination or expiration.

b. Entire agreement

These Terms of Service, together with the Privacy Policy, Community Rules and any additional guidelines provide the entire agreement between you and the Provider and cannot be modified except in writing, signed or otherwise agreed to by both parties, or by a change to these Terms of Service. These Terms and Services supersede any prior agreements between you and the Provider.

c. Waiver

Any failure to exercise or enforce any right or provision of Terms of Service will not constitute a waiver of such right or provision. Any waiver of provisions set out in these Terms of Service will be effective only in writing and signed by both parties.

d. Error free usage

The Provider does not warrant that (i) the Provided Services will meet your specific requirements, (ii) the Provided Services will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Provided Services will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Provided Services will meet your expectations, and (v) any errors in the Provided Services will be corrected.

e. Dispute Resolution

If any provision(s) of these Terms of Service is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect. These Terms and Conditions shall be governed by and construed in accordance with English law and you agree, for the benefit of Dexbonus Community, to submit to the exclusive jurisdiction of the English Courts.

10. Information Requests

Any and all requests for information or documents related to upcoming, potential or ongoing legal proceedings, investigations or disputes must be made using the appropriate legal process and must be correctly served to the Provider. Such requests must be made to an address which can be requested through our email, [email protected]. Requesters will be asked to provide sufficient identification to ensure that the Provider can validate the identity and justification of each request.

Requests for information, documents or press releases made via email, the service portal or fax will not be responded to. All requests must include accurate information which will help the Provider identify relevant records, including, but not limited to, the affected parties username; specific date and time range; information requested; and relationship to investigations. Such requests must be made in person or via recorded postal service to the address which will be provided to you.

Notice 1 - Use of Services

  1. Report any issues or bugs encountered on Dexbonus Services via email to [email protected]. Exploiting any bugs for any reason other than to demonstrate at the request of a staff member will result in a punishment.
  2. Follow any directions given by a Dexbonus Community staff member. If you have a complaint about a staff member, please send an email to [email protected].
  3. You may record your activities on Dexbonus Services subject to the following:
    • You have the express written or recorded permission of everyone recorded.
    • You have the express written or recorded permission to record their creations.
    • All Parties involved are properly credited.
    • Anything uploaded to a non-Dexbonus Service includes links back to the server page for the services the activities were recorded on.
    • Official Dexbonus Community events, including livestreams hosted by Dodger, may not be recorded.
  1. You will not backseat moderate, act like a moderator, take matters into your own hands, or advise our moderators. We do not like BDSM (Backseating, Disruptive or Substandard Moderation).
  2. Dexbonus Community Staff reserve the right to exclude anyone from any and/or all services for any reason without notice.
